Affidavit of Small Succession
An Affidavit of Small Succession is an option, in certain circumstances, to avoid a Succession Proceeding. The main restriction for this option is that the gross value of the assets of the succession has to be $125,000 or less. There are additional criteria that must be met in order to use this option depending on whether the deceased left a valid Will or not, which we will be more than happy to discuss with you. The main advantage of an Affidavit of Small Succession is it is a faster process than the regular Succession Proceeding.
