Understanding the Fair Debt Collection Practices Act

The federal Fair Debt Collection Practices Act (FDCPA) is intended to protect consumers in the United States against deceptive and abusive tactics frequently used by debt collectors. Section 802 of the FDCPA says the following:

“There is abundant evidence of the use of abusive, deceptive, and unfair debt collection practices by many debt collectors. Abusive debt collection practices contribute to the number of personal bankruptcies, to marital instability, to the loss of jobs, and to invasions of individual privacy.”

The Louisiana Fair Debt Collection Practices Act also provides protections to state residents. If you are being targeted by abusive debt collections practices, our attorney will help you understand your rights under these laws and put a stop to the abusive behavior.

Common prohibited practices by debt collectors

How do you know if a debt collector is in violation of the FDCPA? The following are some of the more common violations of the act committed by collection agencies, banks, debt buyers, credit unions and other financial institutions:

  • Using high pressure and aggressive communication tactics
  • Threatening lawsuits for unpaid debts that are beyond the statute of limitations to sue, which is generally three years in Louisiana
  • Making multiple phone calls to you each day
  • Harassing you for debt that is not yours
  • Misrepresenting who they are in order to collect a debt

There are other unlawful tactics that collectors sometimes utilize. If you believe you are being subjected to abusive, deceptive or unfair practices, our attorney will investigate the communications from collectors and work to put a stop to them.

What to do if you are being harassed by creditors and collection agencies

One way to potentially stop harassment is to work with an attorney. Once you have hired a lawyer, the creditors and collections agencies must communicate with you through your lawyer. This collection intervention will not make your debt go away. However, the relief from harassment can provide time for you and your attorney to pursue a reasonable solution. Our full service bankruptcy and debt settlement law firm can help you come up with a plan that suits your situation.
